Now this is disastrous, not only because the richest and most profound aspect of being is lost, but also because such an approach cannot avoid falsifying our understanding of the real. For only in the concrete experience of self--not a knowledge of a certain object that might be so designated, but as the absolutely incom- municable presence of the I --can the significance of being as an absolute and unconditioned value, which at the same time founds a radical plurality whose (...) unique terms resist absorption into a common denominator, be properly grasped. The idea of being envelopes the value of what is most intimate in the subject; the I who thinks being, and the act by which I think it, and my liberty which takes its stand in its presence, and whatever is most interior and most singular in my personal attitude--all this is being, and in being. And instead of relegating the subject to the investigations of some other branch of study, the self, we must insist, occupies a privileged place in metaphysics. Recent controversy about the use of the vertebrate fossil record for external calibration of molecular clocks centers on two issues, the number of dates used for calibration and the reliability of the fossil calibration date. Viewing matters from a palaeontological perspective, we propose three qualitative, phylogenetic criteria that can be used within a comparative framework for the selection of well-constrained calibration dates from the vertebrate fossil record. On the basis of these criteria, we identify three highly suitable new fossil calibration (...) dates for molecular clock estimates: the lungfish–tetrapod split (between 419 and 408 Ma), the bird–crocodile split (between 251 and 243 Ma), and the alligator–caiman split (between 71 and 66 Ma). Together with our previously suggested bird–lizard split (between 252 and 257 Ma), these four fossil dates span a range of very different ages. They are, in our opinion, more suitable for molecular clock calibration than the traditionally used mammal–bird split, which is less well constrained. Founded or unfounded, these objections have not as yet received an adequate answer, i.e., an explanation of the possibility of a philosophy of subjectivity as constituting a reasonable addition to the philosophia perennis, a certain broadening of its perspective, without amounting instead to a simple jettisoning of the thought and gains of centuries. The writings of a Marcel, for example, do not provide such an explanation. Composed wholly within the perspective that is in question, and a little too cavalier in (...) their dismissal of scholastic thought, they cannot really come to grips with that thought, or thereby allay its reasonable suspicions. Even the work of P. de Finance is not wholly satisfactory on this point. As a reviewer of his latest book points out, P. de Finance makes constant and brilliant use of insights gained from the perspective of subjectivity, but he skirts around, without ever really meeting head on, the problems it raises. The difficulty with this point of view and the reason why I characterize it as false do not spring from the mere fact that thought is abstract while experience is concrete. For, on the one hand, the abstract character of thought need not be interpreted negatively, as leaving out the rich variety and profusion of the concrete world in favor of some bare common denominator. Concreteness itself can be seen as a limitation which thought overcomes.ion then becomes an enriching process, (...) a process by which the mind, out of its own superior abundance, illumines and completes the data presented to it, so that from the welter and confusion of particular instances it is able to grasp the universal and valid-for-all, and from the fugitive contingency of the concrete to redeem the abidingly true. In this light, abstractiveness is not a vice but a virtue of thought and, far from weakening the intellectualist position, serves rather to reinforce it. (shrink)

Legal expert systems are computer applications that can mimic the consultation process of a legal expert to provide advice specific to a given scenario. The core of these systems is the experts’ knowledge captured in a sophisticated and often complex logic or rule base. Such complex systems rely on both knowledge engineers or system programmers and domain experts to maintain and update in response to changes in law or circumstances. This paper describes a pragmatic approach using process modelling techniques that (...) enables a complex legal expert system to be maintained and updated dynamically by a domain expert such as a legal practitioner with little computing knowledge. The approach is illustrated using a case study on the design of an online expert system that allows a user to navigate through complex legal options in the domain of International Family Law. The elaboration of a complete and original system of philosophy in any age demands an intellect of great scope and power. In an age like our own, which has become increasingly hostile to systematic thought, it demands a good deal of courage as well. The Modes of Being of Mr. Weiss proves that he possesses both to a high degree.

Methods Young healthy heterosexual couples underwent sleep-lab-based polysomnography of two sleeping arrangements: individual sleep and co-sleep. Individual and dyadic sleep parameters (i.e., synchronization of sleep stages) were collected. The latter were assessed using cross-recurrence quantification analysis. Additionally, subjective sleep quality, relationship characteristics, and chronotype were monitored. Data were analyzed comparing co-sleep vs. individual sleep. Interaction effects of the sleeping arrangement with gender, chronotype, or relationship characteristics were moreover tested. Results As compared to sleeping individually, co-sleeping was associated with about 10% (...) more REM sleep, less fragmented REM sleep (p = 0.008), longer undisturbed REM fragments (p = 0.0006), and more limb movements (p = 0.007). None of the other sleep stages was significantly altered. Social support interacted with sleeping arrangement in a way that individuals with suboptimal social support showed the biggest impact of the sleeping arrangement on REM sleep. Sleep architectures were more synchronized between partners during co-sleep (p = 0.005) even if wake phases were excluded (p = 0.022). Moreover, sleep architectures are significantly coupled across a lag of ± 5min. Depth of relationship represented an additional significant main effect regarding synchronization, reflecting a positive association between the two. Neither REM sleep nor synchronization was influenced by gender, chronotype, or other relationship characteristics. Conclusion Depending on the sleeping arrangement, couple's sleep architecture and synchronization show alterations that are modified by relationship characteristics. We discuss that these alterations could be part of a self-enhancing feedback loop of REM sleep and sociality and a mechanism through which sociality prevents mental illness. (shrink)

This article expands Michel Foucault's (1926-1984) reading of the 'confessions of the flesh' in handbooks of penance written during the central Middle Ages in the first volume La volonté de savoir of his (current) four-volume series Histoire de la sexualité. After the posthumous publication of the fourth volume Les aveux de la chair (2018), in which Foucault takes his analysis of the historical foundations of confessional practices in the late 12th century to the first half of the 14th century even (...) further back, to the 'confessions of the flesh' in the patristics of the 3rd to the 5th centuries, it has become sensible to illuminate Foucault's condensed reading of confessional scripts in La volonté de savoir itself. This exposition pertinently applies to Foucault's correct conclusion that sex was prioritised above all other 'sins', 'vices', and 'transgressions' in central Medieval confessional scripts; therefore, as he famously noted, becoming a 'seismograph of subjectivity in Christian cultures'. Against this backdrop, it is considered how thinkers from the central Middle Ages themselves reflected on the sacramentalisation of confession after the Fourth Lateran Council of 1215 - since Foucault himself did not substantially elaborate on it. The reflections of three philosophers from the central Middle Ages on the relation between sex, confession and absolution are subsequently presented as an expansion of Foucault's reading in La volonté de savoir. Firstly, Alan of Lille's (d.1203) interpretation of the Summae confessorum in his Liber poenitentialis is revisited, concluding that Lille's perspective was 'hermeneutical', in terms of his insistence that the confessor should adjust his interrogations according to seven Aristotelian topoi or detailed questions, designate the context in which the transgression occurred very thoroughly and 'actively participate' in the confessional act, rather than simply recording it. Lille's 'hermeneutical' approach to confession is also reflected in Robert Grosseteste's (ca.1168-1253) De modo confitendi et paenitentias iniungendi, in which a moderate phronetic approach allows for the full discretion of the confessor, rather than following the rigid prescriptions of the Summae confessorum only. Secondly, William of Auvergne's (ca.1180-1249) contribution to the interpretation of the Summae confessorum in his Poenitentia is indicated in his utilitarian ethics, in which the interests of the ethical 'other' is related to the confessing 'self': even though matrimony is for Auvergne the only realm where the other's interests are not necessarily compromised by sexual contact, several considerations regarding 'improper sex', precisely within matrimony, apply according to the relevant penitential guidelines. Thirdly, Paul of Hungary's (ca.1180-1241) De confessione is considered in terms of his reflections on 'paying sexual debt', and on the relation between regulated sexual release and the legitimacy of sexual gratification, again within the context of matrimony. CONTRIBUTION: This article contributes to Foucault-scholarship by elucidating and expanding Foucault's condensed reading of 13th-century confessional scripts in La volonté de savoir, with reference to the relevant texts of Alan of Lille (d.1203), William of Auvergne (ca.1180-1249) and Paul of Hungary (ca.1180-1241). Although law is established on a strong presumption that persons younger than a certain age are not competent to consent, statutory age limits for asking children’s consent to clinical research differ widely internationally. From a clinical perspective, competence is assumed to involve many factors including the developmental stage, the influence of parents and peers, and life experience. We examined potential determining factors for children’s competence to consent to clinical research and to what extent they explain the variation in competence judgments.

During the Weimar Republic, Siegfried Kracauer established himself as a trenchant theorist of film, culture, and modernity, and he is now considered one of the key thinkers of the twentieth century. When he arrived in Manhattan aboard a crowded refugee ship in 1941, however, he was virtually unknown in the United States and had yet to write his best-known books, _From Caligari to Hitler_ and _Theory of Film_. Johannes von Moltke details the intricate ways in which the American intellectual (...) and political context shaped Kracauer’s seminal contributions to film studies and shows how, in turn, Kracauer’s American writings helped shape the emergent discipline. Using archival sources and detailed readings, von Moltke asks what it means to consider Kracauer as the New York Intellectual he became in the last quarter century of his life. Adopting a transatlantic perspective on Kracauer’s work, von Moltke demonstrates how he pursued questions in conversation with contemporary critics from Theodor Adorno to Hannah Arendt, from Clement Greenberg to Robert Warshow: questions about the origins of totalitarianism and the authoritarian personality; about high and low culture; about liberalism, democracy, and what it means to be human. From these wide-flung debates, Kracauer’s own voice emerges as that of an incisive cultural critic invested in a humanist understanding of the cinema. (shrink)
